Terms of use
1. General provisions
These Terms of Use (hereinafter — Terms) govern the relationship between Holymailer (hereinafter — Company, Service) and individuals or legal entities (hereinafter — User) using the Holymailer platform.
By using the Service, the User confirms that they have read these Terms, accept them in full, and agree to comply with them. If you do not agree with the Terms, you may not use the Service.
The Company reserves the right to unilaterally modify these Terms. The current version is always available on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Subject of the agreement
The Company provides the User with access to an email infrastructure management platform, including: ready-made mailboxes on leased or user domains, DNS record setup tools (SPF, DKIM, DMARC), deliverability monitoring, and API integrations with third-party tools.
Access to the Service is provided on a subscription basis according to the selected pricing plan. Available features are determined by the plan.
The Company is not responsible for the content of messages sent by the User through the Service's infrastructure.
3. User obligations
The User agrees to use the Service exclusively for lawful purposes and in compliance with applicable law, including data protection requirements and anti-spam regulations.
The following are prohibited: sending spam and unsolicited commercial messages; using the infrastructure for phishing, fraud, or malware distribution; sharing account access with third parties without written consent; actions that may disrupt the platform or damage the Company's IP and domain reputation.
Violation of these requirements is grounds for immediate account termination without a refund.
4. Pricing and payment
Service pricing is determined by the current plans published on the pricing page. The Company may change prices with at least 14 days' prior notice to the User.
Payment is made in advance for the selected subscription period. Refunds for unused periods are not provided, except as specified in these Terms.
If payment is overdue, the Company may restrict or suspend Service access until the debt is fully settled.
5. Liability
The Service is provided 'as is'. The Company does not guarantee uninterrupted operation but commits to maintaining availability of at least 99% per month (SLA).
The Company's total liability to the User is limited to the amounts paid by the User in the last three months. The Company is not liable for indirect damages, lost profits, or reputational harm.
The User bears full responsibility for all actions performed using their account credentials.
6. Termination
The User may cancel their subscription at any time through their account settings. Service access is maintained until the end of the paid period.
The Company may terminate the agreement unilaterally if the User violates these Terms, with notification sent to the registered email address.
After access is terminated, user data is stored for 30 days and then permanently deleted.
